MINUTES Regular Monthly Meeting Lackawaxen Township Board of Supervisors, Wednesday December 17, 2008 (and Business Meeting of Jan. 5, 2009) The meeting was called to order at 6:30 p.m. by Chairman Stuart, Supervisor Gelderman, Supervisor Krochta, Solicitor Waldron and Municipal Clerk Roe were present.
A motion was made by Stuart to accept the agenda as presented. Second by Krochta. Motion accepted.
A motion was made by Stuart to approve the minutes of last months meeting. Second by Krochta. Motion accepted.
A motion was made by Krochta to approve the bills in the amount of $88,706.58 in the general fund and no liquid fuels . Second by Stuart. Motion accepted. OLD BUSINESS
John McCreary- A motion was made by Gelderman to approve the lot consolidation for Lots #697 & #700 for John McCreary. Second by Krochta. Motion accepted.
Dziedzina/Knoll/Putzrath- A motion was made by Stuart to table the Minor Subdivision/Lot Consolidation for Dziedzina/Knoll/Putzrath for next month. Second by Krochta. Motion accepted.
Nuisance Ordinance- The Next Workshop will be held on January 14,2009 at 6:30 pm. This will be advertised and the public is invited but there will be no public comment.
NEW BUSINESS
D'Addario/Adayev- A motion was made by Stuart to table the Minor Subdivision/Lot Consolidation for next month. Second by Krochta. Motion accepted.
2009 Budget- A motion was made by Gelderman to approve the 2009 Budget. Second by Krochta. Motion accepted.
Resolution #07-2008- A motion was made by Stuart to approve Resolution #07-2008. Second by Krochta. Motion accepted
Auditor- A motion was made by Stuart to appoint Brian Kelly to do the audits. Second by Gelderman. Motion accepted.
Atty Magnotta- Regarding Bakker Issue - Commercial Use not allowed in Rl district. They are requesting a zoning amendment from the supervisors. There was a violation notice issued, but it would not be acted on until the issue is resolved. It was agreed that the time constraints would be waived. A Conditional Use Hearing was not scheduled. It was decided that no more horses would be allowed until this issue is resolved. A meeting would be scheduled with the zoning officer, one supervisor, the solicitor and Atty Magnotta before scheduling a conditional use hearing.
SOLICITOR'S REPORT
Master License Agreement- Regarding Telecommunication Towers for Emergency Service to be located on Township Roads. Still waiting for modifications to agreement. Injunction Hearing- Regarding the Rickard property. The court hearing was held on December 16lh and we are waiting for a decision by the Court. Building Code Ordinance- Received approval from Labor & Industry. An adjustment was made to the ordinance to change the word shed to utility and miscellaneous use structures. It is going from 100 sq ft to 400 sq ft being exempt from building permits. Masthope- Regarding Ice Rink- Requires approval-A formal notification is needed Masthope- Welcome Center- Still requires land development approval Masthope Parking Lot- Plans were sent to Mr. Tachuk. Needed to know by December 10,h if he wanted an open swale or pipe down his property. A letter was received by an attorney for Mr. Tachuk that he was against the basin being placed behind his property and offered to sell his property to Masthope. Mr. Tachuk will be given up until the time Masthope does the work to make a decision. The lights need to be tested before being turned on. The fence should be done by next Thursday. The parking lot can not be used at night until the fence is in place and the lights have been tested. Masthope- Regarding Escrow Account. Solicitor Waldron received an email from Alan Young indicating that they came to a conclusion about numbers. A list of accounting was.provided on how much should be in the escrow accounts. This will need to be compared to the escrow account statements. A memo from the solicitor needs to be sent out regarding lot improvement deeds regarding easements with drainage. Conditional Use Hearings- A stenographer should be at conditional use hearings to establish a record. Some conditional use hearings may not require a stenographer.

WHITE OWL- Motion made by Stuart to approve the Installation/Maintenance Agreement for the Sewage Facility for the White Owl. Second by Krochta. Motion accepted.
Motion by Stuart to adjourn. Second by Krochta. No discussion. Motion accepted.
