MINUTES Regular Monthly Meeting Lackawaxen Township Board of Supervisors, Wednesday November 19,2008 The meeting was called to order at 6:30 p.m. by Chairman Stuart, Supervisor Gelderman, Supervisor Krochta. Solicitor Waldron and Municipal Clerk Roe were present.
A motion was made by Stuart to accept the agenda as presented. Second by Krochta. Motion accepted. A motion was made by Krochta to approve the minutes of last months meeting. Second by Gelderman. Motion accepted. A motion was made by Stuart to approve the bills in the amount of $147,953.77 in the general fund and no liquid fuels . Second by Krochta. Motion accepted.
OLD BUSINESS
John & Laura Olert- A motion was made by Krochta to accept the map for the subdivision of John & Laura Olcrt revised 10/30/08 contingent on wetlands crossing permit. Second by Stuart. Motion accepted.
NEW BUSINESS
Eng- A motion was made by Gelderman to approve the Lot consolidation for Lots #492 & «493 in Masthopc. Second by Krochta. Motion accepted. John McCreary- Regarding Lots #697 & #700 in Tink Wig- Lot #700 is not buildable. There is a carport on lot #700, which the association did give a permit for the carport and the house is on lot #697. The two lots are not contiguous. The two lots can not be subdivided. There is no access from one property to the other property. This would not be considered a lot improvement but \vould be a lot consolidation because there is not a lot line being removed to make a lot improvement. Both lots would have to be sold together and can not be subdivided. A motion was made by Stuart to table the decision for John McCreary for lot consolidation for lot #697 & #700 in Tink Wig. Second by Gelderman. Motion accepted. Masthopc- Regarding parking lot adjacent to ski area. There was a hearing held in the summer of 2007 regarding improvements made to a parking area. The Conditional Use Decision was made in August 2007 and was then appealed to the Pike County Court of Common Pleas. A hearing was held on November 4,h at the Court and as a result it was stipulated on how this matter would be resolved. One of the stipulations was that a plan would need to be submitted to the Supervisors by this meeting and potentially acting on this plan as a modification of what was previously approved. Part of the reason was due to the fact that plans were not provided for two conditions.light shielding plans and plans for screening between the edge of the parking lot and the properties to the south to avoid headlights. Part of the agreement with the stipulation would be that the privacy fence proposed would show the details of the fence and also the maintaining of the fence. It was noted that because of the elevation change on the map the fencing would need to be made higher to accommodate the elevation differences. It was decided that the adjoining property owner of lot #397 would be contacted by Tony. The owner of lot #397 read a letter into the record opposing the storm water drainage plan and health issues. The new plans submitted were at the request of DEP. A recommendation was made by Solicitor Waldron to approve the revised plan but with the condition that right now it is proposed with an open swale, but if Mr. Tachik wants it to be pipe then we will make that adjustment. And also that the privacy fence be located so that it accomplishes the four foot height at the parking lot. A decision needs to be made by December I2,h regarding a pipe or open swale. A motion was made by Stuart to approve the conditions as set forth with the open item being the construction of the swale and of course the privacy fence being 4 feet above the highest spot in the parking lot with the shields to be installed on the lights and to have a test run. so this is conditionally approved with the sketch plan submitted with the revision date of November 14, 2008. Stuart stated there is a motion on the floor to approve conditionally the sketch plans for Masthope with the parking, stormwater. screening and lighting plans with the only remaining item at this point is the open swale by adjoiner, John Tachik. to hear by December I21'1 via communication with Mr.Waldron. Mr Waldron also stated that he recommends that the approval also include that it is subject to all other conditions that were put forth in the stipulation. The court has agreed to them, but they need to be incorporated in to our revised decision. Stuart stated and of course the motion would include the approval of any other and subject to all other stipulations as noted by the court. Second by Krochta. Motion accepted.
Atty Magnotta- Regarding Bakker Issue - Not available- Solicitor Waldron stated that there is a commercial stables and there was never zoning approval. Conditional Use Application was applied for and the plan done by the surveyor showed that it is in the Rl zone. Conditional use was rejected. Commercial Use not allowed in Rl district. Zoning violation issued. They will be looking for a zoning amendment from the supervisors. There are legal fees involved.
SOLICITOR'S REPORT
Master License Agreement- Regarding Telecommunication Towers for Emergency Service to be located on Township Roads. The towers are already put along state roads. There are two township roads that the towers would be put on. This is an essential service. There will be an update provided with modifications to the agreement. Solicitor Waldron recommends signing the agreement after review. They will meet with the roadmaster regarding the location of the towers. There is no ordinance required so this does not need advertising, just approval at a public meeting. White Owl Restaurant- Regarding Sewage System that needs work- An agreement has been made with the adjoing property owner for an easement for the sewage system. A waiver agreement and maintenance agreement would need to be submitted to the supervisors. Schedule a Special Meeting for December 10th at 6:15 pm Nuisance Ordinance- Workshop will consist of an advisory committee, which would not be done by appointment but a volunteer committee and will be open to the public with no public comment. The planning commission would need to review any ordinance before approval by the supervisors. Scheduled for December 10th at 6:30 pm. A motion was made by Stuart to hold a workshop meeting with an advisory committee with the numbers to be announced at the December 17lh meeting and people will be serving on the advisory committee on the 10,h ifthey so choose to participate and to have it at 6:30 at this building and at 6:15 advertisement for the White Owl. Second by Krochta. Motion accepted. Budget - Workshop scheduled for November 26lh at 7:30 am. Building Code Ordinance- Waiting for a response from Labor & Industry. An adjustment was made to the ordinance to change the word shed to utility and miscellaneous use structures. It is going from 100 sq ft to 400 sq ft being exempt from building permits. Violations- Hearing Scheduled for Rickard property for December 16th at 9:30 at Court of Common Pleas. A court order will be issued. The township is seeking attorney fees and all costs and equitable relief. Tink Wig- Regarding Road Access- Kiley Associates was hired by Tink Wig to do a survey. Tink Wig Association needs to get Highway Occupancy Permits for road access to 590. All highway occupancy permits that have been issued by Penndot for the private driveways are still good. Solicitor Waldron suggested that someone from Tink Wig along with himself, and one of the supervisors, ideally Rich as roadmaster and Mr. Hudak meet to see what is being done before moving ahead. Also there may be a need for cost reimbursement. Tink Wig- Regarding Contractor's Yard- Written complaint was received by nine people of Tink Wig. A memo was submitted to the Supervisors. There has been no violation notice issued. This issue will be monitored regularly. David Nicholas- Need to schedule conditional use hearing. A motion was made by Stuart to schedule the conditional use hearing for December 17 at 6:15 pm. Second by Gelderman. Motion accepted.
