MINUTES

Regular Monthly Meeting Lackawaxen Township Board of Supervisors, Wednesday September 16, 2009

The meeting was called to order at 6:30 p.m. by Chairman Stuart, Supervisor Gelderman, Supervisor Krochta, Solicitor Waldron and Municipal Clerk Roe were present.

 A motion was made by Stuart to add the Pike County Humane Society and the Lackawaxen Ambulance under new business to the Agenda.  Second by Krochta.  Motion accepted.

A motion was made by Stuart to approve the agenda as presented.  Second by Krochta.  Motion accepted.

 A motion was made by Gelderman to approve the minutes of last months meeting.  Second by Krochta.  Motion accepted.

 A motion was made by Krochta to approve the bills in the amount of $91,990.66 in the general fund.  Second by Stuart.  Motion accepted.

OLD BUSINESS

 Blue Heron Woods- Regarding Major Subdivision-Final Approval Phase 4- A motion was made by Gelderman to table Blue Heron Woods Major Subdivision Final Approval Phase 4.  Second by Krochta.  Motion accepted.  It is noted that if bond is not submitted by October meeting then this would need to be denied.

 Masthope- Regarding Amendment to Conditional Use for Ski Rental Facility.  A motion was made by Stuart to approve the decision with the conditions.  Second by Krochta.  Motion accepted.

 Stan Sudol- A motion was made by Gelderman to approve the minor subdivision/lot consolidation for Stan Sudol.  Second by Stuart.  Motion accepted.

 NEW BUSINESS

 John Guercia- A motion was made by Stuart to approve the Re-Subdivision at Lake Teedyuskung for John Guercia subject and pending the receipt of the signed page of the deed. Second by Krochta.  Motion accepted.

 Ioannis Konstantakakos- A motion was made by Stuart to table the Minor Subdivision/Lot Consolidation in Masthope. Second by Krochta.  Motion accepted.

 Michael Mancino- A motion was made by Stuart to approve the Lot Consolidation for Parcel #1 & Parcel #2 at Vanderbeek Farm for Michael Mancino.  Second by Krochta.  Motion accepted.

 Vanderbeek Farm- An informal Presentation was given for a commercial public stable to be erected on the Vanderbeek Farm. The architect, Alvin Engel, and the builder, Daniel Glick, were also present to show the plans and designs for the stable.  A land development plan would also be needed. 

 Summer Rec. for Children- Regarding Adding a Maintenance Shed- A motion was made by Stuart to schedule a public conditional use hearing for October 14th at 6:00 pm .  Second by Gelderman.  Motion accepted.A permit would be needed to demolish the existing building.

 Pension Plan- Need to appoint Shawn Roe as Chief Administrative Officer for Pension Plan-A motion was made by Stuart to appoint Shawn Roe as Chief Administrative Officer for the Pension Plan.  Second by Krochta.  Motion accepted.  

Comprehensive Plan- A motion was made by Stuart to schedule the Public Hearing for the Comprehensive Plan for October 14th at 6:15 pm .  Second by Gelderman.  Motion accepted.

 Pension Plan- A motion was made by Stuart to approve the budgeting for the MMO for the Pension Plan.  Second by Krochta.  Motion accepted.

Cinders- A motion was made by Krochta to accept the bid of Ciccone for $13.17 per ton.  Second by Stuart.  Motion accepted.  

Lackawaxen Ambulance- A motion was made by Stuart to schedule a workshop for October 14th at 7:15 pm or following the Comprehensive Plan Public Hearing with the Lackawaxen Ambulance.  Second by Gelderman.  Motion accepted.  There will be no public comment allowed.

 Pike County Humane Society- A motion was made by Stuart to give the Pike County Humane Society $2000.00.  Second by Krochta.  Motion accepted.

A presentation was given by Barry, the owner of the Pike County Humane Society.  A letter would be sent to the Pike County Commissioners asking for their support to the Pike County Humane Society. 

 SOLICITOR’S REPORT

  Lackawaxen Telephone- Regarding Non-Exclusive Franchise Agreement- The existing ordinance with regards to Blue Ridge Cable was reviewed by our solicitor.  This franchise agreement with Lackawaxen Telephone can also be done by Ordinance and this would require a public hearing.  Solicitor Waldron will do research on new Franchise Agreements.  The ordinance will be drafted and provided by the November meeting.  The ordinance will also need to be advertised in November for the December hearing.

A motion was made by Stuart to schedule a public hearing for December 9th at 6:00 pm for the Franchise Agreement with Lackawaxen Telephone.  Second by Krochta.  Motion accepted.

Zoning Violations- Two matters still being dealt with in court.  Rickard hearing has been rescheduled for September 29th.  Regarding Roy Property, Jeff and Solicitor Waldron met with the owner and their attorney on the property.  The owner agreed to have the school bus moved by May 1st.  There are only two unlicensed vehicles on the property.

Nuisance Ordinance- Solicitor Waldron is working on the redraft of the ordinance, which will now be the Public Safety & Welfare Ordinance.  This will be done no later than Monday and provided to the Supervisors for review and comment.  The ordinance will address certain concerns, mostly related to noise, but not vehicles.  The ordinance will be revised before submitting to the committee, which that meeting with the committee will be held on October 21st at 5:30 pm.  A notice will be sent out to the committee.  The revised ordinance will also be sent out to the committee for review by October 6th.  With the revisions to this ordinance there will have to be another public hearing, which will be held on November 11th at 7:00 pm. 

John McKay- Conditional Use scheduled for September 9th for John McKay has been rescheduled for November 11th at 6:00 pm.  A request was received from his attorney asking for an extension of time.  Solicitor Waldron did receive a signed acknowledgement indicating that they would waive the timing requirements because this is beyond the 45 days from the last hearing.

Laurel Ridge- Solicitor Waldron has not contacted the Laurel Ridge Association.  He would speak with Joe Hudak to see if they could make arrangements with the person of the Laurel Ridge Association to meet with him.
