MINUTES Regular Monthly Meeting Lackawaxen Township Board of Supervisors, Wednesday June 24, 2009
The meeting was called to order at 6:30 p.m. by Chairman Stuart, Supervisor Gelderman, Solicitor Waldron and Municipal Clerk Roe were present.
A motion was made by Stuart to approve the agenda as presented. Second by Gelderman. Motion accepted.
A motion was made by Stuart to approve the minutes of last months meeting. Second by Gelderman. Motion accepted.
A motion was made by Gelderman to approve the bills in the amount of $164,220.38 in the general fund. Second by Stuart. Motion accepted.
OLD BUSINESS
Nuisance Ordinance Workshop- Announcement made by Stuart. A workshop will be held on June 29th at the Lackawaxen Fire Station at 6:30 pm.
White Owl- A motion was made by Stuart to deny the application in respects to the White Owl regarding the tavern/restaurant conditional use decision. Second by Gelderman. Motion accepted.
Tisnovsky/Banks- A motion was made by Stuart to table the minor subdivision/lot consolidation. Second by Gelderman. Motion accepted.
South Canaan Tower- A motion was made by Stuart to approve the conditional use decision of South Canaan Cellular Telephone Corporation with the conditions set forth herein. Second by Gelderman. Motion accepted.
NEW BUSINESS
Pike County Conservation- A presentation was given by Bob Engvaldsen.
Resolution #2009-08- A motion was made by Gelderman to approve the Resolution #2009-08 concerning the Lackawaxen Fire Commission. Second by Stuart. Motion accepted.
Comprehensive Plan- Regarding the approval of the extension until December 31, 2009 by the Pike County Commissioners for SRCP grant contract. A motion was made by Stuart to execute this document. Second by Gelderman. Motion accepted.
Alternate Inspector- A motion was made by Gelderman to appoint Bob Bates as the alternate building/electrical/commercial inspector. Second by Stuart. Motion accepted.
Yousef Abbasi- Regarding lot consolidation for lots #1 & #2 & #3. A motion was made by Stuart to recommend denial as submitted. Second by Gelderman. Motion accepted.
SOLICITOR'S REPORT
Laurel Ridge Development- A meeting was held on June 23rd with Ellen Salak from the conservation district, Joe Hudak, Rich Krochta and the Millers. A report will be written by Joe Hudak and provided to everyone. Masthope Mortgage Escrow Account- A meeting was held with Alan Young, attorney of Masthope, Bill Owens, accountant for Masthope, Solicitor Waldron, Shawn Roe and Rich Krochta. There are a lot of unanswered questions. One of the things that made sense and would be a good use of township ability is to try and resolve it even though it would require a lot of Shawn's time, is to go through the township minutes from 1972 to the present regarding this account. At least 10 to 15 hours probably more than that from what Solicitor Waldron could tell have been spent on this. A report was provided to the solicitor last week up to 1984 so far, and Shawn is now beyond that, but is also typing all of this information because other parties need to review this information. The reports are starting to show why there are differences in the amount they think we should be holding and the amount that we are holding. There are some feelings that once we provide all this information we may need to depose someone regarding the history of this, but most of the issues seem to be between 1978 and 1995. It is a lot but it should be done before the July meeting. It appears that the next step would be that Bill Owens, the accountant, would come here and review what Shawn has earmarked. Urban/Shook Property- The subdivision plan was submitted at the June meeting. The sewage testing has been done. The sewage module was submitted today. No action will be taken. Regarding Resolution #2009-09 for th Pike County Scenic Rural Character Preservation Program. As mentioned at the last months meeting, the land in the back which is approximately 148 acres, the township is not acquiring that but has entered into an option agreement assuming the township goes through with the first part to have an option up to 18 months to acquire tha if we can get funding. A resolution #2009-09 has been prepared by Solicitor Waldron, which would be for the purpose titled Notice of Intent to Participate in the Pike Scenic Rural Character Preservation Program, which says that the township wants to participate in the program to enter into an option agreement to acquire the 148 acres to be reserved as open space and be used as a township park. This option would be contingent upon acquiring both county and state funding for this. This notice needs to be filed by the end of June and is recommended by the solicitor. A motion was made by Stuart to adopt Resolution #2009-09 to participate in the Rural Scenic Character Preservation Program. Second by Gelderman. Motion accepted. Solicitor Waldron also attended a meeting on behalf of the township at Delaware Highlands Conservancy and asked them if they would consider being involved in the project, because is you were able to get funding you are required to actually, since the township would own the land, it is required that there be a conservation easement held by an independent organization that would make sure that the property was never developed. They would be more than interested. There is no language on the map regarding the wetlands, which Solicitor Waldron will give to Kiley. Solicitor Waldron will be attending the meeting by DCED regarding the gambling monies for grants. Zoning Matters- There are three matters that needed to be pursued in the Pike County Court System because they were not resolved at the Magistrate level. A petition of contempt has been filed in the court on one of the matters. They have until July 9th to comply or answer the petition. If it is resolved by then there will not be a hearing, but if not the court will schedule a hearing date. The other two matters, one which we went to the magistrate twice and got no resolution. There is a hearing scheduled for July 21st on the Roy Property and the other one is the Spence Property also scheduled for July 21st.
