MINUTES

Regular Monthly Meeting Lackawaxen Township Board of Supervisors, Wednesday March 18, 2009

 

The meeting was called to order at 6:30 p.m. by Chairman Stuart, Supervisor Gelderman, Supervisor Krochta, Solicitor Waldron and Municipal Clerk Roe were present.

 

 A motion was made by Gelderman to approve the minutes of last months meeting.  Second by Krochta.  Motion accepted.

 

A motion was made by Stuart to approve the bills in the amount of $174,554.07 in the general fund and $6,629.31 in liquid fuels .  Second by Krochta.  Motion accepted.

 

OLD BUSINESS

 

Dziedzina/Knoll/Putzrath- A motion was made by Stuart to table the Minor Subdivision/Lot Consolidation.  Second by Krochta.  Motion accepted.

 

Nuisance Ordinance Workshop- Announcement made by Stuart.  A workshop will be held on April 6th at the Township Building at 7:00 pm. 

 

Giorgi/Blanco- A motion was made by Stuart to approve the Minor Subdivision/Lot Consolidation for Lots #189 & #190 & #191 in Fawn Lake.  Second by Krochta.  Motion accepted.

 

NEW BUSINESS

 

Alternate Engineer- A motion was made by Stuart to appoint McGoey, Hauser & Edsall as alternate engineer for Lackawaxen Township.  Second by Krochta.  Motion accepted. 

 

White Owl- A motion was made by Stuart to schedule a conditional use hearing for April 8th at 6:00 pm.  Second by Krochta.  Motion accepted.

 

Costa’s- A motion was made by Stuart to schedule a conditional use hearing for April 8th at 6:30 pm.  Second by Krochta.  Motion accepted.

 

SOLICITOR’S REPORT

 

White Owl-  Regarding replacement of sewage system- A letter of credit was received from the Dime Bank in the amount of $26,000 for a one year period.  After receipt of this letter the sewage permit will be issued to the White Owl.

Mortgage Account- Research has been done regarding the number of lots that should have paid the escrow money when they were sold.  The amount held in escrow does not match the number of lots that should have paid the escrow money.  This is believed that when the lots were transferred there was no release payment submitted to the township for approval.  It has already been agreed in principal, not formally agreed, that the township would turn over the money to Masthope as long as it would be dedicated toward maintenance and or improvements of the facilities that it was originally created for.  The best way to finish this is to put this in front of the court.  The collection of the money not paid would be up to Masthope on how they want to deal with that issue.

Violations- There are two equity actions regarding Roy & Spence.  The Roy property is regarding violations of our ordinance relative to the junk provisions.  Spence involves a property that is occupied and the only permit issued was for a shed, which they are living in part time. There was no house built.  

Laurel Ridge Development- Update regarding storm water issue- It was agreed, that Ellen Salak of Pike County Conservation, and the township engineer will be going to the site.  Pike County Conservation did find a plan, which the solicitor did go and look at the plan.  There were drainage ditches but no detention basin on the plan.

Multi Municipal Comprehensive Plan- Waiting for response from surrounding townships.  They have 45 days to respond.

Township Building- A motion was made by Stuart to approve the Land Development Plan for the Lackawaxen Township Building.  Second by Krochta.  Motion accepted.

 

 

ANNOUNCEMENTS

 

Park Reserved- Park is reserved on July 12th for St. Marks Church

 

Public Comment was had.

Executive Session would be held before adjournment of regular meeting.  There will be no further business conducted.
